Since the Hamas massacre in Israel on October 7th, the criminal justice system in Germany has decided in some places to react unusually harshly. A strict new line seems to apply, especially in Munich. This is shown by a decision from the Munich I Regional Court, which has initially been discussed within the judiciary in recent weeks (file number 29 Qs 27/23). Anyone who publicly declares their support for the Palestinians’ “right to resist” can therefore potentially be prosecuted under criminal law.
